DOMESTIC VIOLENCE
Domestic Violence is one of the most common offenses in the State. Many times the situation involves alcohol or money. If the victim declines to cooperate, the charges are often dismissed. If you or your loved one has a valid defense, or someone is manipulating the system, Wolfe Legal Services can help.
We defend people wrongfully charged with domestic violence and/or assault. A vigorous and aggressive interview with all witnesses is important to make sure the truth is known. In domestic relations court, I can also assist victims to help protect them from further harm.
§ 2919.25 = Ohio's Domestic Violence Law Condensed Version
No person shall knowingly or recklessly cause, threaten, or attempt to cause physical harm to a family or household member.
Generally, Domestic Violence is a misdemeanor of the fourth degree. A violation of involving actual physical harm is a misdemeanor of the first degree.
If the offender previously has been convicted of domestic violence, a violation involving harm is a felony of the fourth degree, and a violation involving threats is a misdemeanor of the second degree.
If the offender previously has been convicted of two or more offenses of domestic violence, a violation involving harm is a felony of the third degree, and a violation involving threats is a misdemeanor of the first degree.
"Family or household member" means any of the following:
- Any of the following who is residing or has resided with the offender:
- A spouse, a person living as a spouse, or a former spouse of the offender;
- A parent or a child of the offender, or another person related
- A parent or a child of a spouse, spouse, or former spouse...
- The natural parent of any child of the offender...
"Person living as a spouse" means a person who is or has cohabited with the offender, within five years prior...
